Terms and Conditions

1. Definitions

Agreement
These Terms and Conditions, together with the registration form and any other documents referred to within these Terms and Conditions.
Parent
The individual who registers the student for services provided by Spark Academy and is responsible for payment of fees.
Student
The child or young person receiving tutoring services from Spark Academy.
Services
The tutoring services provided by Spark Academy, including online tutoring, in-person tutoring, and hybrid tutoring.
Spark Academy
CRT Enterprises Ltd trading as Spark Academy.
Fees
The charges payable by the Parent for the provision of Services as set out in the Agreement.
Enrolment Fee
The annual fee charged to cover the setup costs of registration.
Flexible Plan
A payment plan with a minimum commitment of three months, thereafter rolling monthly with a 30-day notice period for cancellation.
Annual Plan
A payment plan committing to 12 months of Services with no cancellation option within this period.
Online Tutoring
Tutoring services delivered via the internet over 47 weeks per year.
In-person Tutoring
Tutoring services delivered face-to-face over 38 weeks per year.
Hybrid Tutoring
A combination of online and in-person tutoring services.

3. Agreement Overview

By enrolling a Student in Spark Academy, the Parent agrees to these Terms and Conditions, forming a binding Agreement.

The Agreement begins on enrolment and continues until terminated under these Terms.

4. Services Offered

4.1 Online Tutoring

4.1.1 Spark Tribe - Group Tutoring

  • Affordable online group tutoring with larger classes.
  • Lessons run Monday–Thursday, 5:40 pm – 8:00 pm (subject to variation).
  • Interactive group sessions promoting collaboration.
  • Access to Spark Learning platform.

4.1.2 Spark 1:1 Online Tutoring

  • Personalised one-to-one tutoring sessions.
  • Tailored to individual student needs.
  • Access to Spark Learning platform resources.

4.2 In-Person Tutoring

  • Face-to-face lessons over 38 weeks per year.
  • Structured learning with experienced tutors.
  • Hands-on interactive activities.
  • Access to Century Tech platform.

4.3 Hybrid Tutoring

  • Combination of in-person and online tutoring.
  • Online sessions over 47 weeks per year.
  • In-person sessions over 38 weeks per year.
  • Access to Spark Learning and Century Tech platforms.

5. Registration and Enrolment

5.1 Registration Process

  • Completion of online registration form required.
  • Includes student details and relevant information.
  • Enrolment fee required for in-person or hybrid tutoring.

5.2 Annual Enrolment Fee

  • Non-refundable fee for administrative setup.
  • Covers accounts, assessments, and resources.

6. Fees and Payment Terms

6.1 Online Tutoring Fees

  • Monthly subscription paid in advance.
  • Payments taken on the 1st of each month.
  • Pro-rata charges apply for mid-month enrolment.

6.2 In-Person and Hybrid Tutoring Fees

  • Annual Plan: 12-month commitment, no cancellation.
  • Flexible Plan: 3-month minimum, then rolling monthly with 30 days’ notice.

6.3 Payment Methods

  • Credit or debit card payments.
  • Payments due monthly or as agreed.

7. Charges for Overdue Fees

9. General Cancellation Terms

9. General Cancellation Terms

9.1 Cancellation by the Parent

The Parent may cancel the tutoring services provided by Spark Academy at any time after the initial 14-day cancellation period, subject to the terms outlined below.

9.2 Notice Period

To cancel the tutoring services, the Parent must provide written notice to Spark Academy, specifying the intended date of cancellation. The notice period shall be 30 days from the date of receipt of the written notice by Spark Academy.

9.3 Effect of Cancellation

Upon cancellation of the tutoring services, the Parent shall remain liable for any outstanding fees owed to Spark Academy up to the effective date of cancellation. Such fees shall be payable in accordance with the terms outlined in Section 6 (Fees and Payment Terms).

9.4 Cancellation Terms for Different Plans

Annual (12 Month) Plan

If the Parent cancels the Annual Plan before the expiry of the 12-month commitment period, they shall remain liable for payment of the full annual fee. No refunds shall be provided for early cancellation of the Annual Plan.

Flexible Plan

The Flexible Plan requires a minimum commitment of three months, after which it transitions to a rolling monthly agreement. Parents must provide 30 days' notice for cancellation after the initial three-month period. Cancellation within the 12-month commitment period shall incur payment of the remaining fees for the minimum term specified.

30-Day Subscription (Online Group Tutoring)

Parents opting for the 30-day subscription for online group tutoring may cancel their subscription at any time with 30 days' notice. The notice period commences from the date of subscription and must be provided in writing. The Parent remains liable for payment of the total contractual amount during the notice period, and no refunds shall be given if the Student does not attend lessons during the notice period.

Online 1:1 Tutoring (Block Sessions)

For Online 1:1 Tutoring, Parents must pay for blocks of 10 sessions in advance. Upon cancellation of the tutoring services, any unused sessions within a paid block shall not be refunded.

9.5 Refund Policy

If the Parent cancels the contract within the time period stipulated in this agreement, Spark Academy will make any repayment without undue delay and no later than 14 days after the day the Parent communicates cancellation in writing. Refunds will be made using the same payment method unless otherwise agreed, and no fees will be incurred by the Parent.

9.6 Notice of Payment Failure

Spark Academy reserves the right to cancel and stop the Student’s course with immediate effect should a monthly payment remain outstanding for longer than 5 days.

10. Refunds

10.1 Eligibility for Refunds

Refunds shall be issued in accordance with this section and applicable conditions.

10.2 Refund Policy

Spark Academy operates a refund policy in compliance with the Consumer Rights Act 2015 and relevant consumer protection legislation.

Refunds will not be provided in the following circumstances:

  • Cancellation after the 14-day cooling-off period. The Parent remains liable for services used up to cancellation.
  • Cancellation of Annual Plan. No refunds for early termination.
  • Unused block sessions for Online 1:1 Tutoring.
  • Missed lessons. No refunds are given, but learning materials will be provided via the e-learning platform.

10.3 Exclusion of Pupil

A Pupil may be excluded for:

  • Breach of Spark Academy Rules;
  • Non-payment of Fees;
  • Unreasonable behaviour as determined by the Director.

In all cases of fixed or permanent exclusion, Fees remain payable as set out in this Agreement. Excluded pupils require written permission to re-enter premises.

10.4 Refund Process

  • Refund requests must be submitted in writing with supporting information.
  • Requests will be reviewed within a reasonable timeframe.
  • Approved refunds will be processed within 14 days.
  • Refunds are made using the original payment method unless agreed otherwise.

10.5 Dispute Resolution

Disputes will be resolved through informal negotiation. If unresolved, mediation or alternative dispute resolution may be used.

11. Service Interruptions, Force Majeure, and Dispute Resolution

Parents or legal guardians are responsible for supervising their child's participation in Spark Academy's tutoring services, whether online or in-person. They must ensure the child behaves respectfully and appropriately during sessions and follows Spark Academy’s behavioural expectations.

12.2 Attendance and Punctuality

13. Medical Information

13.1 Disclosure of Medical Conditions

Parents or legal guardians must disclose any relevant medical conditions, allergies, or special requirements before tutoring begins.

13.2 Confidentiality and Data Protection

All medical information will be treated confidentially in accordance with GDPR and relevant data protection legislation. It will only be used to support the child's participation and safety.

13.3 Consent for Emergency Treatment

Parents or legal guardians consent to Spark Academy seeking emergency medical treatment where necessary during tutoring sessions. Reasonable efforts will be made to contact parents unless immediate treatment is required.

13.4 Notification of Changes

Parents or legal guardians must notify Spark Academy of any changes to medical conditions or requirements promptly.

13.5 Indemnification

Parents or legal guardians indemnify Spark Academy against claims arising from emergency medical treatment provided in good faith.

14. Complaints Procedure

15. Pupil Property

15.4 Liability Waiver

Students and parents acknowledge the risks of bringing personal property and waive claims against Spark Academy where permitted by law.

16. Data Protection and GDPR

Spark Academy is committed to providing a safe and healthy environment for Students, staff, and visitors. All activities shall comply with the Health and Safety at Work etc. Act 1974 and relevant legislation.

20.2 Responsibilities of Spark Academy

Spark Academy shall implement health and safety policies, conduct risk assessments, and ensure facilities and equipment are maintained safely. Staff will receive appropriate health and safety training.

20.3 Responsibilities of Parents and Students

Parents must ensure their child understands and follows all health and safety rules. Students must comply with instructions and report any concerns immediately.

20.4 Emergency Procedures

Spark Academy shall provide clear emergency procedures, including evacuation plans, for fire, medical emergencies, or other incidents. Parents must ensure Students are aware of these procedures.

20.5 First Aid and Medical Assistance

Qualified first aid personnel will be available during sessions, with appropriate first aid supplies accessible. In emergencies, Spark Academy will provide assistance and contact emergency services where necessary.

20.6 Reporting and Recording Incidents

All accidents and incidents must be reported promptly. Spark Academy will maintain accurate records and implement follow-up measures where required.

21. Safeguarding and Child Protection

21.2 Responsibilities of Spark Academy

Spark Academy shall appoint a Designated Safeguarding Lead (DSL) responsible for safeguarding oversight. All staff will receive regular safeguarding training and must follow safeguarding policies at all times.

21.3 Reporting Concerns

Any safeguarding concerns must be reported immediately to the DSL, including concerns relating to abuse, neglect, or exploitation. All reports will be taken seriously and acted upon promptly.

21.4 Confidentiality and Information Sharing

Safeguarding concerns will be handled confidentially and in accordance with data protection laws. Information will only be shared with relevant authorities on a need-to-know basis.

Spark Academy is committed to promoting equality and inclusion and ensuring that all Students, Parents, and staff are treated fairly and with respect, in accordance with the Equality Act 2010.

22.2 Non-Discrimination Policy

Spark Academy does not discriminate on the basis of race, ethnicity, nationality, gender, sexual orientation, disability, religion or belief, age, or any other protected characteristic. All Students have equal access to services and resources.

22.3 Reasonable Adjustments

Reasonable adjustments will be made where possible to support Students with disabilities or special educational needs. Parents are encouraged to inform Spark Academy of any requirements at enrolment.

22.4 Anti-Bullying Policy

Spark Academy operates a zero-tolerance policy towards bullying, harassment, and discrimination. All incidents will be addressed promptly under disciplinary procedures.

23. Termination of Agreement

23.1 Termination by the Parent

The Parent may terminate the agreement at any time, subject to written notice as set out in Section 9 (General Cancellation Terms). The notice period shall be 30 days from receipt of written notice by Spark Academy.

23.2 Termination by Spark Academy

Spark Academy reserves the right to terminate the agreement and cease providing services with immediate effect in the following circumstances:

  • Non-payment of fees as outlined in Section 7 (Charges for Overdue Fees)
  • Repeated breach of Centre Rules or policies
  • Unreasonable behaviour affecting Students, staff, or reputation
  • Any material breach of these Terms and Conditions

23.3 Effect of Termination

Upon termination, all obligations cease except for outstanding payment obligations or clauses that survive termination. The Parent remains liable for fees up to the termination date.

No refunds will be issued except where expressly stated in Section 10 (Refunds).

Upon termination of the agreement, the Student shall return any property, materials, or equipment belonging to Spark Academy in their possession. The Parent shall be liable for any costs associated with the replacement of property not returned or returned in a damaged condition.

Any disputes arising out of or in connection with the termination of the agreement shall be resolved through informal negotiation where possible. If a resolution cannot be reached, either party may pursue mediation or other alternative dispute resolution methods in accordance with applicable law.

24. Miscellaneous Provisions

24.1 Amendments

Spark Academy reserves the right to amend these terms and conditions from time to time. Any changes will be communicated in writing or by email and will take effect upon notification. Continued use of services constitutes acceptance of the amended terms.

24.2 Governing Law and Jurisdiction

This agreement and any disputes arising from it shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes.

24.3 Severability

If any provision of this agreement is found to be invalid or unenforceable, it shall be modified or removed only to the extent necessary. The remaining provisions shall remain valid and enforceable.

24.4 Entire Agreement

This agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings. The Parent acknowledges that no external statements or promises have been relied upon outside of this document.

24.5 Waiver

Failure by Spark Academy to enforce any right or provision shall not constitute a waiver of such rights. Any waiver must be expressly confirmed in writing.

24.6 Third-Party Rights

No third party shall have any right to enforce any term of this agreement under the Contracts (Rights of Third Parties) Act 1999.

All notices must be in writing and delivered by hand, post, or email to the relevant address provided.

  • Post: deemed received on the second business day after posting
  • Email: deemed received the next business day after sending
